Working in Poland as a Foreigner—Where to Start?

Have you found a job opening in Poland and want to respond quickly? First, check two separate issues: whether the basis for your stay allows you to work, and whether you need a document authorizing you to enter the Polish labor market. A job offer, a residence permit, or an insurance policy alone do not resolve either of these issues.

Start by determining your own status, and only then evaluate job offers. You’ll know what documents to present to the employer and whether the proposed terms meet the requirements for legal employment. This guide takes you step by step through the process: from checking your residence documents, to choosing the right procedure and verifying the company, to carefully reading the contract.

First, check the basis for your stay and your right to work

Legal residence and access to the labor market are related, but they are not the same thing. A third-country national needs a residence document that grants the right to work. This may be an appropriate visa or a residence permit, but what matters is the specific basis for issuing the document, not just its name.

So don’t assume that every residence card automatically grants an unlimited right to work. The notation „access to the labor market” depends on the basis for the residence permit granted. In some situations, a foreign national must additionally obtain a work permit, unless a specific provision exempts them from this requirement.

Before you start your search, make sure you have the following:

  • passport or other travel document;
  • a visa, a residence card, or a decision regarding residence;
  • documents confirming the basis for residence;
  • information regarding any work permit or exemption from the requirement to obtain one;
  • copies of documents that you can safely provide to your employer during the paperwork process.

If you're just starting to sort out your residency matters, be sure to also read the guide on residence card and proof of legal residence. You can also find official information regarding the relationship between residence and employment on the website Office for Foreigners.

⚠️ Important

An insurance policy is not a document that, in and of itself, legalizes a person’s stay or employment. Each document must be evaluated based on its actual function.

⚠️ Important

Before signing the contract, make sure its terms match the job offer and the document authorizing you to work.

Determine what kind of document you need for work

As a general rule, a third-country national needs a document authorizing access to the Polish labor market, unless the law provides for an exemption. Depending on the situation, this may be a work permit, a seasonal work permit, a declaration authorizing the employment of a foreign national, or a temporary residence and work permit.

Don’t determine which document you need based solely on the job title. Factors such as your immigration status, citizenship, and the type of work you plan to do are also important. Before accepting an offer, clarify with your employer the basis on which your employment will be legalized and who is responsible for the various formalities.

Once you have obtained a permit or registered a declaration, you must work under the terms specified in that document and exclusively for the employer indicated therein. If your employer or your terms of employment change, do not assume that your current document is still valid. First, check whether the change requires new paperwork.

The rules governing the employment of foreign nationals are set forth in the Act of March 20, 2025, and its implementing regulations. Current guidelines for third-country nationals are published by Ministry of Family, Labor, and Social Policy. Before you begin, compare your document with the current official information, as exceptions depend on your individual status.

Does a student need a work permit?

There is no one-size-fits-all answer for all students. In certain cases, a foreign national studying in Poland may work without a permit. This applies to specific grounds for residence, including, among others, a national visa issued for the purpose of study as indicated by the authorities, or an appropriate temporary residence permit for the purpose of study. This rule should not be extended to every visa, every type of study program, or every residence situation.

Search for an employer safely

You can look for a job on your own or through a temporary employment agency. In the first option, you browse job listings and contact the company directly. The official job portal helps you find job listings for which you apply directly to the listed employer.

Don’t immediately send scans of all your documents to someone you don’t know. First, confirm the company’s full name, address, and registration details. It’s a good idea to check the employer’s status in the REGON or KRS databases. Also, check whether the recruiter’s email address is associated with the company and whether the details in the job posting match the information provided during the interview.

If you're using a private employment agency, check it in the National Register of Employment Agencies. A professional-looking website or social media profile is no substitute for checking the agency in the register.

Evaluate bids based on a fixed set of questions:

  • who is the actual employer;
  • where and in what position you will be working;
  • what terms should be included in the contract;
  • What document will qualify you to enter the job market;
  • whether the conditions set forth are consistent with the permit or statement;
  • Will you receive the documents in a language you understand?.

You can find more resources on employment and education in the section Work and Study in Poland. Official guidelines on how to find a company and verify a broker are also published by Public Employment Services Portal.

Review the offer and contract before signing

Do not sign a document whose contents you do not understand. When working with an agency, you should receive a translation of the contract in language you can understand before signing it. A written contract with the agency should include key information, such as the employer’s details, working conditions, and compensation.

An employment agency cannot charge a fee for job placement alone. However, it may charge a fee for translating documents. Therefore, evaluate each payment based on its specific purpose. Ask for a written explanation of what the fee covers, and keep a receipt.

Before signing the contract, compare it with the job offer and the document authorizing you to work. First and foremost, check the employer’s name, job title, work location, hours of work, and salary. If any of the details differ from those in your work permit or declaration, clarify the discrepancy before your first day of work.

Keep your own copies:

  • announcements and correspondence with the recruiter;
  • the agreement and its translations;
  • a work permit, declaration, or other document required for employment;
  • residence permit;
  • confirmations of document submission and payment.

Frequently Asked Questions About Foreign Workers

Does a residence permit always allow you to work?

No. Your eligibility depends on the basis for your residence permit. The notation „access to the labor market” does not mean that anyone can take any job without additional conditions. Check your decision, your card, and the rules applicable to your specific status.

Can I start working before I finish the paperwork?

Don't start until you have the proper basis for your stay and the required document granting you access to the labor market—or a confirmed exemption from that requirement. A promise from an employer alone does not substitute for the required documents.

Can I work for a company other than the one specified in the permit?

You must perform the work for the employer specified in the permit or declaration and under the conditions set forth therein. Before changing employers, check to see if you need to complete any new paperwork.

How do you check out an employment agency?

Verify the agency in the National Register of Employment Agencies. Compare the registration details with the contract and the information provided by the recruiter. Do not base your decision solely on a job posting or a social media profile.

Can an agency charge a fee for finding a job?

They cannot charge a fee for their services alone. They may charge a fee for translating documents. Before paying, ask for a detailed breakdown of the costs and a receipt.

Can a student in Poland always work without a permit?

No. The exemption applies to specific grounds for residence and study. Check your visa or residence permit and the latest official information. In the section Work and Study in Poland You'll also find related guides for foreign nationals.

Does insurance entitle you to work?

No. Insurance may be a separate document related to coverage or residency procedures, but it does not replace the document authorizing access to the labor market. Determine your right to work based on your status and the relevant official documents.

Start with the correct order

First, determine whether your residence permit entitles you to work. Next, check whether you need a permit, a declaration, or any other document. Only then should you evaluate the job offer, verify the employer, and compare the contract with the conditions specified in the document authorizing you to work.

Don't skip these checks just because you're under pressure to start work quickly. Clarify any discrepancies between the job offer, the contract, and the legal basis for employment before your first day at the company.
